Insolvency

In the current climate, insolvency is an issue that may affect many, whether as an individual or a company. Prompt advice is always crucial.

For individuals this may include, for example, advice as to bankruptcy, debt management or an Individual Voluntary Arrangement. We have close ties with Insolvency Practitioners and can offer prompt and specific advice tailored to the individual situation.

If you are a director, you may wish to obtain advice with a view to steering your company through these tough times. We will advise accordingly, however if rescue is an unachievable aim we can offer advice as to the winding up of your company, placing it into a Company Voluntary Arrangement or perhaps into Liquidation. Again, with close ties to Insolvency Practitioners we can provide you with the right advice and, if necessary, refer you to an Insolvency Practitioner to begin the process.

We also act on behalf of directors in defending disqualification proceedings and claims brought by Insolvency Practitioners.

If you are an Insolvency Practitioner we can issue winding up petitions, bankruptcy petitions, orders for possession and sale, applications for charges under section 313 Insolvency Act, 1986 and book debt collection.

We have a wide experience in dealing with various forms of insolvency litigation, including preference claims, transactions at an undervalue, wrongful trading issues and director / shadow director misfeasance. We also act in the sale and purchase of assets and businesses from or for Insolvency Practitioners.
