Our team understands how emotionally difficult a separation can be. Having a Separation Agreement in place can enable both parties to address their financial positions, should they not be ready to issue formal Divorce proceedings.

A Separation Agreement is a document that records an agreement between both parties, following the end of a relationship. They can be used for both married and unmarried couples, setting out how their assets will be divided.

Married couples may seek to put in place a Separation Agreement when they do not wish to start formal divorce proceedings, but want a financial agreement in place for peace of mind. 

The Agreement can be flexible to meet your needs, depending upon what your financial position may look like. For example, you may wish to include who is going to pay for the house, how the furniture will be divided, or the arrangements for any children.

Separation Agreements are not legally binding but can carry significant weight if drafted correctly and fairly. Such Agreements are often made into a Consent Order, within divorce proceedings, to make the agreement legal binding. It is advisable to ask a lawyer to properly draft a Consent Order before the document is filed with the Court.
