Pre-Nuptial and Post-Nuptial Agreements are a way to protect your individual assets before and after entering into a marriage.
Pre-Nuptial Agreements
A Pre-Nuptial Agreement is a
legal document, prepared and signed before parties get married. The Agreement will need to be signed no less
than 28 days before the wedding, following the couple fully disclosing their
financial position to one another.
The Agreement will set out how
the assets will be divided in the event of divorce. The document will also set
out any responsibilities the parties will have to one another following
separation. This will depend upon their individual circumstances, and any
change to such in the future, to include if one party gives up their career to
raise the children.
For a Pre-Nuptial Agreement to
remain fair, it will need to regularly be updated with any new event or change.
This can include having children, change in earnings, inheritance received or
if one party is no longer able to work due to a disability. The document (if
amended once parties are married) will then become a Post-Nuptial Agreement.
Post-Nuptial Agreements
A Postnuptial Agreement is made
after the marriage has taken place and they are extremely useful when there is
a change in circumstances. The document can be reviewed and updated throughout
the marriage to reflect the ongoing position of the parties; however, both
parties must be in agreement to any changes.
Both Agreements are recommended
to protect individual assets especially if there is financial imbalance in your
relationship.
