Arrangements for Children

When parents separate, the biggest worry is the children and how the arrangements will be addressed. We understand that this can create additional worry and stress for parents. Here at Bowcock Cuerden, we aim to promote co-parenting and positive communication between parents, so far as possible.

We have extensive experience of dealing with matters ranging from issues relating to parental responsibility, removal from the jurisdiction and addressing the day to day arrangements.

Our team will try and resolve any issues at the earliest opportunity, ensuring such is in your children’s best interests. Should parents be unable to reach an agreement, Mediation would be the next step, in the hope of avoiding Court proceedings. A Mediator is an impartial third party who facilitates discussions between parents to assist in finding common ground, and compromise. 

Should Mediation be unsuccessful, you may wish to consider an application to the Court. A Child Arrangements Order is a Court order which will determine where the children shall live and when they will spend time with the other parent. Throughout proceedings, the Court will encourage parents to reach an agreement between them, however, should matters proceed to a Final Hearing, the Court will make an Order in whatever terms they deem to be in the children’s best interests.

The Court will also address other issues relating to your children, which can include addressing a specific issue, or seeking that the Court prohibit a parent in some regard. This can include prohibiting one parent from re-locating with the children, of which could threaten their relationship with the other parent.  The Court will always make a determination based upon what is in the children’s best interests.
