A non-molestation order prohibits an person from using or threatening physical violence and other unwanted behaviour.
A non-molestation order application has to be against a person who has “association” under the Family Law Act 1996 which includes partners whether you were married or not or those that have a child together.
Occupation Orders restrict the rights to occupy the home. They are only a short-term solution and do not affect what happens to your property in a final settlement.
