Registration of title to land was created in 1925 and was phased in, so unregistered land is still common.
The Land Registry encourages registration of title voluntarily by offering a reduced fee for such applications.
There are many advantages to registering title to property:
- Once registered, title to the property is guaranteed by the government
- Registration provides a certain amount of protection against claims for adverse possession by third parties
- The risk of lost or destroyed deeds is eliminated
- Title to the property is easy to prove, as all registered titles can be viewed electronically. This makes any future sales, transfers or re-mortgages easier, quicker and more straightforward.
